If I am convicted of DUI, will I have to go to jail?
In Washington state, the law places mandatory minimums on sentencing for a DUI conviction. Even for a first DUI conviction, you will be required to spend 1 day in jail if your BAC level was below .15 percent, or if your case is one where you did not submit a breath test, yet did not refuse the breath test. A first time DUI offender faces even stiffer mandatory minimums if convicted of DUI with a BAC level above .15 percent, or if they refuse to submit a breath sample. In those cases, there is a minimum sentence of 2 days in jail.
If you have previous convictions for DUI within the past seven years, the mandatory minimums on sentencing for a DUI conviction rise sharply. This will include convictions for lesser charges such as Reckless Driving if the original charge was for DUI.
The minimum jail time for DUI if you have one prior offense within the past 7 years is 30 days in custody, plus 60 days on Electronic Home Monitoring, for cases where your breath or blood alcohol concentration was less than .15 or where there was no test result. If your breath or blood alcohol concentration was above .15 or if you refused the test, the minimums for DUI with one prior offense within 7 years are currently 45 days in jail and 90 days of Electronic Home Monitoring.
For two or three prior offenses within 7 years, the minimums rise to 90 days in jail and 120 days Electronic Home Monitoring for cases below an alcohol concentration of .15, and 120 days in jail plus 150 days Electronic Home Monitoring for levels over .15 or refusals.
